Although the company has not recalled its Biomet M2a-Magnum hip system, a federal court in Indiana has consolidated dozens of lawsuits into a multidistrict litigation, or MDL. The Biomet Magnum is a metal-on-metal hip replacement system that received premarket approval from the U.S. Food and Drug Administration through its controversial 510(k) expedited review process. The FDA essentially greenlights such devices without clinical testing if the product is substantially similar to other products already approved for implantation.

Unfortunately, the Biomet M2a-Magnum has proven to be all too similar to other devices such as the DePuy ASR hip replacement and the Smith & Nephew R3 system, which have been recalled.

Among major problems with the Biomet Magnum reported to the FDA are:

• Revision surgery needed in as little as 3 to 5 years for a hip joint that is supposed to last 15 to 20 years
• Revision rates twice as high as some other metal-on-metal hips
• Bone loss or soft tissue damage from metallosis, which is caused by chromium and cobalt particles leaching into nearby tissues
• Chronic pain or inability to stand or walk
