Most New York car accident cases settle somewhere between $15,000 and several hundred thousand dollars, and serious-injury crashes reach seven or eight figures. The biggest driver is how bad and how permanent your injury is. Sullivan & Brill offers a free case review, and you pay nothing unless we win.
You want a number. That’s fair. But any lawyer who gives you a firm figure before reading your medical records and the police report is guessing. What we can do is show you how car accident value actually gets calculated in New York, and what pushes a case up or down.
Two crashes that look identical on paper can settle for wildly different amounts. A fender-bender with a stiff neck and a herniated disc that needs surgery are not the same case, even if the cars took the same hit.
What decides the value of a New York car accident case
Insurers and juries weigh the same core factors. So do we when we value your claim.
- Severity and permanence of your injury. A full recovery is worth less than a spinal fusion or a traumatic brain injury you’ll live with forever.
- Medical bills, current and future. Surgery, physical therapy, injections, and care you’ll still need years from now all count.
- Lost income and lost earning capacity. Time off work, plus any hit to what you can earn going forward.
- Pain and suffering and life impact. What the injury took from your daily life, your sleep, your independence.
- Available insurance coverage. A claim is often only as big as the policies behind it, including your own underinsured motorist coverage.
- Comparative fault. Since May 26, 2026, New York has used modified comparative negligence for motor vehicle claims: your recovery drops by your share of blame, and it is eliminated entirely if your share is greater than the other driver’s.
How insurers put a dollar figure on pain and suffering
There’s no formula written into law, but adjusters lean on two methods. The multiplier method takes your medical bills and lost wages and multiplies them, often by 1.5 to 5, based on how severe the injury is. The per-diem method assigns a daily dollar value to your suffering and multiplies it by the days you’re affected. Both are starting points for negotiation, not ceilings.
New York’s No-Fault threshold matters
To sue for pain and suffering after a car crash, you generally have to clear the serious injury threshold under Insurance Law §5102(d), things like a fracture, significant limitation of a body function, or permanent consequential limitation. No-Fault covers your basic medical bills and some lost wages regardless of blame, but the pain-and-suffering money lives on the other side of that threshold. Proving you cross it is often where a case is won or lost.
A real Sullivan & Brill result
We secured a $4,000,000 settlement for a 26-year-old injured in a car accident. Prior results do not guarantee a similar outcome. Every case turns on its own facts, but it shows what serious injuries backed by solid proof can be worth.
Deadlines you can’t miss
The general statute of limitations for a New York car accident claim is three years from the crash. If a government vehicle or agency is involved, you may have just 90 days to file a Notice of Claim. Wait too long and the strongest case in the world is worth nothing.
Our fee is contingency-based. There’s no fee unless we win money for you. Want to know what your claim might be worth? See our case results, read more on our car accident practice page, or contact us for a free review.
Car accident value questions New Yorkers ask
Can I still recover money if the crash was partly my fault?
It depends on how much of the fault is yours. For lawsuits filed on or after May 26, 2026, New York applies modified comparative negligence to motor vehicle claims: if you were 40% responsible you recover 60% of your damages, but if you were 60% responsible you recover nothing. Cases filed before that date follow the old pure comparative rule, which only reduced the award.
What is the No-Fault serious injury threshold?
It’s the legal bar under §5102(d) you must clear to sue for pain and suffering, such as a fracture, permanent limitation, or significant limitation of a body part or system.
How long do I have to file a car accident lawsuit in New York?
Generally three years from the date of the crash. Claims against a government entity can require a Notice of Claim within 90 days, so act early.
Does a settlement offer from the insurer mean it’s fair?
Not usually. Early offers tend to come in low, before your future medical needs are clear. Have a lawyer review any offer before you sign a release.
How much does it cost to hire Sullivan & Brill?
